TENNESSEE’S CODE FOR UNDERAGE DRIVING WHILE IMPAIRED (T.C.A. 55-10-415)
Tennessee has some of the strictest underage DUI laws in the country. Drivers who are under the age of 21 who are found to have a blood alcohol concentration (BAC) of .08% or more could be convicted of a standard DUI. But drivers who are under the age of 21 could be convicted of an underage DUI with a BAC as low as .02% but not .08% or more. If the driver is between the ages of 16 and 18, they could be charged with a delinquent act, but if the driver is between the ages o 18 and 21, they could be charged with a misdemeanor.
WHAT PENALTIES DOES A MINOR FACE FOR DRIVING UNDER THE INFLUENCE IN TENNESSEE?
While the penalties a minor faces for being convicted of an underage DUI are generally less severe than the penalties they would face with a standard DUI, there are still penalties that could have an impact on their lives and futures. The penalties for an underage DUI are the same for both delinquent acts and misdemeanor acts, meaning the penalties are the same no matter what the driver’s age. The primary difference in the penalties between a standard DUI and an underage DUI is a driver charged with a standard DUI faces potential jail time while a driver charged with an underage DUI does not face jail time. The penalties a driver charged with an underage DUI could face include:

A one-year license suspension. While a driver convicted under a standard DUI is allowed to obtain a restricted driver’s license during their suspension period, a driver convicted of an underage DUI is not eligible to obtain a restricted driver’s license.

Being ordered by the judge to complete community service hours. This penalty replaces the jail time penalty faced by a driver convicted of a standard DUI.

Being ordered by the judge to pay a fine of $250
