Firearm theft now gets a mandatory sentence
As of July 1, 2019, the penalties for stealing a handgun in Tennessee just got steeper. SB0403/HB0167 passed in the latest legislative session, which affected the penalties for several criminal offenses, including the theft of a firearm.
Specifically, the law now mandates that anyone convicted of theft of a firearm must serve a 30-day jail sentence. This sentence is in addition to any other penalties imposed for the theft or related crimes. Reports had indicated that Tennessee had experienced an 85 percent increase in gun thefts from motor vehicles over a two-year period. Many people blamed the state’s lax laws regarding gun storage in vehicles, though others claimed that lawful gun owners should not be to blame – instead, the firearm thieves should be punished more severely. This now-mandatory jail sentence provision followed.
MORE SENTENCES ARE UPDATED IN 2019
Firearm theft was far from the only criminal sentence affected by the new laws that went into effect on July 1. The law increased charges or penalties for the following offenses, as well:
- Bringing a telecommunications device such as a smartphone into a correctional facility increased from a Class E felony to a Class D felony
- A fifth conviction for driving under the influence (DUI) increased from a Class E felony to a Class D felony
- Removed the lookback period for multiple DUI charges, so prior convictions from any time period can be considered, including convictions for aggravated vehicular homicide in DUI cases, vehicular homicide, vehicular assault, or aggravated vehicular assault
The difference between a Class E felony and a Class D felony is dramatic and important to consider. For example, consider the following possible penalties:
- Class E felony = One to six years in state prison and fines up to $3,000
- Class D felony = Two to 12 years in state prison and fines up to $5,000
You could potentially serve twice as long in prison under the new law for a fifth DUI conviction or bringing a smartphone into a prison. In addition, more people may face fifth DUI charges based on the removal of the lookback period.
On the other hand, the charges and penalties for certain offenses were reduced in 2019, including:
- Failing to appear for a court date was reduced to a Class A misdemeanor from a Class E felony
- Possessing unlawful drugs in prison went to a Class D felony from Class C felony
- The habitual offenders act that increased punishment for multiple vehicular offenses was repealed
