What are your Miranda rights?
Miranda rights consist of four distinct statements:
1. You have the right to remain silent.
2. Anything you say can and will be used against you in a court of law.
3. You have the right to an attorney.
4. If you cannot afford an attorney, one will be appointed for you.
These rights are at the heart of the American legal system and are rooted in the Fifth Amendment protection against self-incrimination. If the warning is not provided, anything you say during an interrogation likely can’t be used in trial.
When does a police officer have a duty to read your Miranda rights?
Two distinct factors precede the reading of Miranda rights: A subject must be in custody and they must be under interrogation. Notable here is that custody does not necessarily mean arrest. If you feel a police officer is blocking your free movement and questioning you, you are owed a Miranda warning.
Are there exceptions?
There are a few scenarios where Miranda rights do not apply, including if the questions being asked are related to basic booking procedures and if the police are engaging with someone under an active hostage situation. Likewise, something like a standard traffic stop does not constitute being in custody, even if you don’t feel free to drive away.
