What is considered robbery in Tennessee?
The act of taking something from a person or a business that did not originally belong to you can be classified as 3 different things in the state of Tennessee. If you take something that isn’t yours, you could be charged with theft, robbery, or burglary. And while these may seem like the same thing, but they are actually separate crimes with separate consequences.
To be accused of robbery, you must have allegedly used violence or terror in the taking of property from another person, and it is broken down into three categories, as described below:
- Robbery : The intentional theft of property using fear or violence. This is a Class C felony that , if convicted, could result in 3 to 15 years in prison and/or $10,000 in fines.
- Aggravated robbery : Robbery that includes the use of a lethal weapon or display that leads the victim to believe the aggravator possesses one or if the victim suffers serious bodily injury. This is a Class B felony that, if convicted, could result in 8 to 30 years in prison.
- Especially aggravated robbery : The use of a lethal weapon that results in serious bodily injury. This is a Class A felony that, if convicted, could result in 15 to 60 years in prison.
Because each subsection of robbery is considered a felony, if you are convicted you won’t be getting off with a light sentence. A felony conviction stays with you for the rest of your life and makes applying for employment and education especially difficult. In addition, a charge of this severity can’t be expunged from your record and you will no longer be able to vote or legally carry a weapon.
