Imagine this: There’s been a burglary at a jewelry store, and a witness describes the suspect to a law enforcement officer.
“She had brown hair and a tattoo on her arm,” says the witness. While walking around the area near the store, the officer spots at least three women who fit that description.
To make a legal arrest, more information is needed. But what kind of information?
That’s where probable cause comes into play. Probable cause may be established when there are credible facts that show someone is likely responsible for a crime.
Understanding the Basics
Probable cause usually comes up in cases where an officer engages in an arrest, search or seizure without a warrant. The officer establishes probable cause by testifying they had a logical belief that a crime had been committed, was being committed or would have been committed.
Examples of Probable Cause
One example: In a robbery case, information from an informant that a suspect would be arriving on a particular train, wearing specific clothes and carrying a certain bag is not enough to establish probable cause. A judge needs to know whether the informant was reliable and what the informant’s basis is for such knowledge.
No Clear Standard
Many types of evidence can establish probable cause, and a judge will determine whether probable cause was established on a case-by-case basis. Note that an officer can detain a person for a short period without probable cause, such as when stopping a pedestrian or vehicle.
