Electronic Harassment
Legal consequences of harassment via electronics
The internet has been one of the greatest inventions in human history. It has made information more accessible than ever. It has enabled us to remain in constant contact with people around the world and it has helped spur technological advances at a greater rate than at any previous point.
Unfortunately, the internet has not been completely positive. In fact, there are some unintended consequences that have resulted in overwhelmingly negative outcomes. The negative effects have been particularly powerful for children and teenagers.
Stories continue to be reported, all too frequently, about suicides resulting from online harassment. The ability to remain constantly connected means that it can be difficult, even nearly impossible, to avoid an individual who is being consistently cruel and vicious. Even when they can be somewhat ignored, the harasser is able to post lies and slander on the internet, spread rumors, and work rather effortlessly to inflict misery upon their target.
In addition to social media postings, people being harassed can be overwhelmed by hurtful text messages sent directly to them or sent about them. It can become nearly impossible to prevent or avoid being harassed. Under these circumstances, it is no wonder that children and teenagers may see suicide as their only option.
Electronic harassment occurs when someone intentionally in writing or by electronic communication, including, but not limited to, text messaging, facsimile transmissions, electronic mail or Internet services, to take action known to be unlawful against any person and by this action knowingly annoys or alarms the recipient.
However, this is not the case. If you or a loved one are being harassed, there are options. First and foremost, the law is on your side. In Tennessee, harassment is a Class A misdemeanor. Under certain circumstances and conditions, it can be a Class E felony.
If you are the victim of harassment or think you may be, you have rights. While it can seem difficult at the moment, remember that you do not have to be subjected to this detrimental form of treatment. When you think you may be the victim of harassment, seek assistance.
