Domestic Violence
Understanding domestic violence charges in Tennessee
Domestic assault cases are tricky and can involve a vast array of factors. First of which includes the definition of a domestic relationship — it involves more than just a husband and a wife. A domestic relationship can be classified as any of the following:
• Former Spouse
• The Father/Mother of Your Children — Regardless of current marital status
• An Individual Related by Either Blood or Marriage
• Your Roommate
• Your Current Spouse
What Happens During a Domestic Assault Charge?
In the case that the authorities are called to an area where an alleged domestic assault has occurred, the police are responsible for identifying the primary aggressor. They are then required to remove that individual from the premises and escort them to jail. Should the aggressor be released from jail with a pending court date, the bond conditions require that the defendant stay away from the alleged victim and have no contact with that person.
From there, Tennessee laws state that several different outcomes are possible. Common punishments for domestic assault include:
• Anger Management
• Jail Time
• Monetary Fines and Court Costs
• Loss of Right to Carry a Firearm
• Counseling
• Other Punishment Alternatives
