Aiding and abetting is known as an “inchoate,” or incomplete, crime. It involves taking a step toward committing a crime.
What does it mean to be involved “before the fact” and “after the fact”?
Helping someone “before the fact” involves assisting with a crime before it’s committed. If the crime is a robbery, that could mean creating a plan or even crafting an alibi for the robber.
Helping someone “after the fact” involves ensuring the perpetrator succeeds after the crime is committed. That could mean hiding evidence or helping them escape.
What penalty could you face?
States differ as to how an accomplice is charged. Many states do not separate helping a criminal and committing the crime yourself. An accomplice can be charged with anything from a serious felony like attempted murder to a misdemeanor like petty theft.
Penalties can include a prison sentence, probation, fines, community service and monetary compensation.
What does the state have to prove?
Typically, the state must prove you knew of a perpetrator’s plan to commit a crime and you intended to assist. They must also try to prove what you did to help the perpetrator. If you’re charged as an accomplice, you should seek representation from a different attorney than the perpetrator.
