When is a search allowed?
Most of the time, police need a search warrant to search someone’s phone. However, a warrantless search is allowed when the phone is on and clearly displaying illegal content or if the owner or another party with access to the phone gives consent. Border agents can also search your phone when you are crossing the border.
What are your rights?
A person’s right to keep information on their cell phone private is guaranteed by the Fourth Amendment of the U.S. Constitution. Specifically, it guarantees a person the right to be free from unreasonable searches and seizures. In 2014, the Supreme Court ruled that police cannot conduct a warrantless search of a phone of a person who has been arrested.
What about students?
Students have a more narrowly defined right to privacy. This is especially true for a K–12 student on a school campus. State laws differ as to how much privacy schools grant students.
What about social media accounts?
State privacy laws can extend the rights of phone owners. Certain states, like California, have laws that also protect social media accounts on phones. However, police can still request that social media companies provide them with content a user shared on the platform.
Can police actions be limited?
